Respected Madam,

 

After receiving specific complaint, we have conducted fact finding on the incident where the victim, minor girl was immorally trafficked as alleged by their family members. The incident took place within the jurisdiction of Baduria Police Station, District-North 24 Parganas, West Bengal, which is bordering area with Bangladesh. The family members of the victim approached to the said police station with specific allegations of forcible abduction and immoral trafficking and the police discharged their duty by only registering a criminal case, but till date no positive outcome has been achieved since the police took up the investigation of the case. The victim girl is yet to be rescued, till six months passed away. The police are also reluctant to arrest the accused persons who are freely roaming in the area.

 

The incident show that the life of the victim is at peril due to indifference and inaction of the police authorities. This is yet another case of harassment, dereliction of duty and torture by the perpetrator police officials and also another example which shows that the police official has no intention to deal with the cases of abduction and immoral trafficking diligently and effectively. Our attached fact finding report gives details of the incident.

 

Hence, we seek your urgent intervention in this matter in the following manner:- 

  • Concerned police authorities of Baduria Police Station are to be directed to take action immediately to rescue the victim girl.
  • An impartial and independent investigation, preferably by CID is to be initiated against the perpetrator police officials and stern judicial action is to be taken against them.
  • We also demand that appropriate charge(s) must be incorporated under The Immoral Trafficking (Prevention) Act (ITPA) in the FIR and the police must be directed to probe accordingly.

Particulars of the victim: - Ms. Sayera Khatun (name changed), by faith-Muslim, aged about-15 years, having parental house at village- Padmapukur, Police Station-Baduria, District-North 24 Parganas, West Bengal, India.

 

Case Details:-

 

The victim was given marriage with Mr. Abdulla Mondal son of Fakir Ahmed Mondal in the same village. It is revealed during our fact finding that the victim was immorally trafficked on 30.5.2011 when she came to her father's house. The victim's father came to know that Mr. Mahasin Sardar alias Khokan, son of Mr. Abdul Hossain Sardar and Mr. Monirul Mondal, son of Moslem Mondal, both resident of village-Gokulpur, Police Station-Swarupnagar were involved in the forced abduction and immoral trafficking of his daughter. The victim's father several times went to local Baduria Police Station to lodge complaint against the alleged traffickers. But in spite of the repeated requests by the father of the victim, the police refused to register any first information Report against the alleged traffickers. Later the victim's father submitted one written complaint before the Superintendent of Police, North 24 Parganas as a result of which the police of Baduria Police Station registered one First Information Report (FIR) being Baduria Police Station Case no. 288 dated 15.8.2011 under sections 363/366 of Indian Penal Code against the aforesaid accused Mr. Mahasin Sardar and Mr. Monirul Mondal. The victim's father also disclosed in the said FIR that he received information that the accused traffickers sold her to the flesh traders in Bangalore.

 

The father received one phone call after his daughter was trafficked, from one mobile number – 08050552154. The victim girl informed her father that she was sold out at Bangalore to the flesh traders and requested to rescue her. All these information was duly informed to the Baduria Police.

 

The police discharged their duty by only registering an FIR against the accused persons. No attempt has been made by the police till date to arrest the accused persons in spite of the fact that they are still residing in their residence. Moreover the police have deliberately failed to rescue the victim till date. The complaint of the victim's father before the police disclosed allegations of immoral trafficking by the accused traffickers but the police did not bring any charge under the relevant provisions of Immoral Trafficking (Prevention) Act against the accused persons.
